Land fraud in Kenya is rarely sophisticated. It works because buyers skip steps under time pressure. Here is the sequence that closes the gap.

Most land fraud in Kenya is not clever. It relies on a buyer who is in a hurry, a seller who seems credible, and a step that gets skipped because everyone is keen to close. The defence is not legal genius — it is refusing to move through the sequence out of order.

The four patterns that account for most losses

The order that protects you

Do an official search at the land registry first, and do it yourself or through your own advocate — never on a copy handed to you by the seller. Confirm the registered proprietor, the parcel number, the size, and any encumbrances, cautions or charges recorded against it.

Then confirm the person in front of you is that registered proprietor, with identification that matches. If they are acting for someone else, the power of attorney must be genuine, current and specific to this transaction. Where a company holds the title, ask for the resolution authorising the sale.

Only then visit the land — with a surveyor, not just with the agent. Beacons should exist and match the deed plan. Ask neighbours who owns it. A parcel that is occupied by someone the seller did not mention is a parcel with a problem.

Never pay a deposit to secure a property you have not searched. Urgency is the seller’s tool, not yours.

Where the money should go

Payments belong in a traceable channel with a paper trail — through an advocate, or through a platform that records what was paid, for what, and when. Cash handed over at a viewing to secure a property is the single most common way people lose money in this market, and it is completely avoidable.
